12 Days for Justice (3-12)

Alito is sooo NOT sexy...terrifying seems more accurate.

This is an attempt to organize actions involving groups on a local level, as well as, directly adding to the voices speaking to Senators and the Judiciary committee.

Perhaps such actions will help Senate Democrats and, maybe, even some Republicans gain the courage required to reject Alito.

Following the "12 Days of Christmas," I am offering reasons to reject Alito and suggest actions that can be taken.

Days 1 and 2 are described "here"

Humming, "On their third day back from recess I worked for Justice by..."

Day 3: Action directed to Senators and Judiciary Committee (e-mails, faxes, phone calls, snail mail),

Is Alito a man to be trusted? A man of his word or ethically challenged?

From the Washington Post

"Democrats said they will press Alito to explain other circumstances in which his statements have conflicted to some degree. When confirmed to a federal appeals court in 1990, Alito told senators he would not rule in matters regarding the investment firm Vanguard Group Inc., in which he had several accounts. Alito did rule in a 2002 case involving Vanguard, however, and later gave several accounts of the circumstances. He said a courthouse computer program failed to alert him to the potential conflict of interest; that he was not legally or ethically bound to recuse himself; and that his statement to the senators applied only to his first few years on the court."

Think Progress has an update on Alito's excuses for not recusing himself.

A possible visual aid might be the scales of justice tipped to one side with a bag of $ on it.

Day 4: Action directed to Senators and the Judiciary Committee and local actions.

People For the American Way has a 24 page PDF providing a preliminary view of Alito's records. He was not very supportive of people with disabilities.

The Coalition for a Fair & Independent Judiciary includes the American Association of People with Disabilities. However, the AAPD site does not have info on it about Alito.

The action for today would be to let senators and Judiciary Committee would be an expression of importance of protecting rights of ALL citizens.

MilitaryTracy when we began thinking about this suggested sending photos (with permission) of family and friends with disabilities - personalize the issue - remind our senators that Alito's decisions would affect real human beings.

On the local level, this action would be to contact (via e-mail or phone) local organizations involved with disabled people (and their families), letting them know they need to beware of Alito and to contact senators and the judiciary committee.

Day 5: (humming that tune) Prot-e-e-e-ct Roe v. W-a-a-a-de

Direct action to senators and judiciary committee.

In Man Eegee's Diary, "here", ConnecticutMan1 offered a coat hanger with the universal NO symbol - a reminder of days before Roe v. Wade.

Brinnainne suggested photo of mom with kids, and a caption, "I had a choice."

My thought was an outline of a woman with the Capitol building in a universal NO symbol "in utero" and a caption, "The government doesn't belong here."

NARAL is offering an activism packet.

Day 6 and 7 (Sat. and Sun.): Action directed locally.

Think Progress has two notices now on conservatives pushing an "Anti-Alito= Anti-God" campaign and using Alito's court opinions to present him as the "Christmas candidate."

There are a couple of religious groups in The Coalition for a Fair & Independent Judiciary; one is the "Religious Coalition for Reproductive Rights" which includes Episcopal, Presbyterian, United Methodist, United Church of Christ, Unitarian, and Jewish.

Action would be to contact religious communities to beware of Alito and begin taking actions contacting senators and the Judiciary Committee.

Day 6: Direct Action to senators and judiciary committee and local action.

Alito was a member of CAP (Concerned Alumni of Princeton); this group was concerned with the admittance of minorities and women to Princeton - lowering "standards."

Alternet has the story.

My suggestion is to send a "graduation CAP" with the caption, "Education is for All Americans." And a letter about Alito's past in CAP, noting his pride in membership in his 1985 application and his reluctance now to own up.

Local action would be contacting local teachers associations and unions, informing them of Alito's membership in CAP and the importance of being informed about Alito, inviting them to contact senators and the judiciary committee about their concerns.

People For the American Waywrite, "Alito's decisions on civil rights raise a number of troubling questions about his commitment to strong enforcement of the nation's laws intended to protect people from discrimination. In a number of instances, Alito issued opinions that made it far more difficult for victims of discrimination to get to court and prove their cases. Alito's decisions appear to be especially harsh in the areas of gender and race discrimination, where he has dissented from Third Circuit decisions and sought to make it much harder for victims of race and sex discrimination to prove discrimination."

Day 9: race discrimination - HUGE - ideas needed

Day 10: gender discrimination - HUGE- ideas needed

Day 11: immigration/environment/workers rights? - ideas needed

Day 12: sending a photo of you/family/friends/neighbors to senators and the judiciary, "This is what America looks like. Reject Samuel Alito."

Is it possible to do this?

I keep wanting to throw up my hands and say, "This is too much. It is too hard."

But when I think of Alito on the court I can only think, "How can I not do this?"

I tell you what. When this gets figured out I'm just going to print it all out and head to DC myself. I feel spent. really. I'm disappointed in myself for not feeling creative and energized on this. I was immensely optimistic at the start. There have been no replys from other blogs as of yet and this place here feels almost poisonous right now and so much energy is being directed into arguing with one another. That includes me as well. I guess it's contagious. This is the second of Tampopo's diaries to slide away and I'm a little ashamed for her.

I'm going back to work and see if I can shake off this pessimism and get back here and focus.

You have just summed up my feelings so perfectly that I have nothing to add.

Tampopo, I'm sory that I haven't been more creative/helpful with this.  Cabin the Elder is interested in doing some of the artwork/graphics to help.  I'm drowning in a sea of school and work-related paper right now, and too burnt out to be creative.  Point me in a direction though, and I will follow up and do whatever needs to be done (like the drone that I think I am right now)...

Ah Supersoling, don't be so harsh on yourself. I understand.

As I was working ont this I kept thinking, "Crap. Why did I say I would do this? What was I thinking!"

My ideas fizzled by days 9, 10, and 11 - I just wanted to write, "This is wrong, wrong, wrong!"

Checking this AM before heading off to errand, I thought, "Oh well." Then I heard from Manny. And thought, "Oh good."

But I am not doing this with the expectation of anything from anybody else. Don't get me wrong here, folks wanting to contribute ideas are most welcome!

I just feel such pressure to DO something to counter BushCo.

I have learned about Alito, so I figure I can hold my own in conversations in the next few weeks with people I encounter.

I have learned about all kind of groups that I never knew existed.

I have learned how to do links.

So I am going to keep on working on this.

I know you're there. I know you care. And I know you will do what you can. Who could ask for anything more?

activist judiciary (clemons' piece re: guns)

second class minorities (CAP)

diluted democracy (reapportionment)

police state impunity (shoot first)

a fundie theocracy (Religious Liberty and Church-State Separation from the PFAW piece)

Conservatives aren't waiting. They are active now. (Don't they ever rest?)

They are calling Alito the "Christmas candidate" because his opinions have helped keep Christmas decorations up.

And the Dems are focusing, legitimately, on Alito's failure to recuse himself from a case and the variety of changing excuses he is giving now.

Sounds familiar doesn't it?

Oh, CabinGirl, I don't want our next meeting to be at a protest as Alito is sworn in.

When I proposed this I was thinking about trying to make it "fun" somehow, hence the thought of using the holiday song.

My thought had been more folks might become interested and involved. So the song was more to initiate ideas.

Is there time or energy available to weigh the pros and cons of "took from me" or "gave to me?"

My hope is that protests that start when the hearings start will just be a continuation of what we  do before the hearings.

Um, my latest thought is to use some of Cedwyn's suggestions, have people each select a day or theme that resonates with them, and create that day's activity. In other words, maybe someone like Teacher Toni could do the CAP thing, Militarytracy or DJ (I know they're both swamped right now) could do something for his positions on the disabled, ManEe on immigration issues, and so on.  That spreads the responsibility to a manageable level, and makes things less daunting.  If people have ideas to share with others, great!  

I vote for some kind of phone/fax/email to our representatives EVERY day.  It's easy for lots of people to do if we provide the format like we did for OYF.

Each day a diary could be posted for the NEXT day. The diary would be the e-mail/fax/message to send.

We certainly don't lack for writers here! Time and energy are the great limitations.

Well, the next step then is to start asking/assigning topics to people and due dates for their contribution.   Because the dates are consecutive, it would give people an opportunity to work on it.  Do the simple ideas first, and save the more complex ones for last (maybe the "full monty" on the final fax?)  Since it's only a 1-pager type thing, it's not such an overwhelming commitment to ask of anyone.

Day 9: race discrimination - HUGE - ideas needed

Is there anyway to work the NOLA disaster in to this theme? It has certainly become a bit of a symbol of the modern day "race issues". (At least for most many people?)

Just a suggestion.

As for the "image" I put up... It is more of a suggestion for a direction. I am certain that one of the many artists on this site could do something that would blow that out of the water. I would hope that a few would try on this short time schedule.

Images of the horror of Katrina and the ongoing nightmare just kept going through my mind too. I get so angry I can't think straight. Makes it a bit difficult to write something coherent.

As to your "image," would you consider writing an e-mail/fax that would accompany it?

Here's what I am thinking:

You create a diary with your image and accompanying letter, titled, "For Justice - DAY 5."

You post it on Day Four, Dec.15th, making it available for people to use the next day, Day 5, to e-mail/fax to senators and the judiciary committee.

Does this make sense?

If I can get in touch with Brinnainne, I will ask her to do the same. Then people have a choice of styles.

What does Samuel Alito think about women and abortion rights?

In Judge Alito's 1992 dissent in Planned Parenthood of Southeastern Pennsylvania v. Casey, Alito argued that a law requiring a woman in certain circumstances to notify her spouse before seeking an abortion did not pose an undue burden on a woman's right to choose. Alito asserted that if parental notification requirements were constitutional, as the Supreme Court had previously held, then spousal notification requirements must be permissible as well. (Planned Parenthood of Southeastern Pennsylvania v. Casey, 947 F.2d 682 (3d Cir. 1991), aff'd in part, rev'd in part, 505 U.S. 833 (1992).)

Alito's colleagues on the Third Circuit and a 5-4 Supreme Court majority disagreed.

Writing for that majority, Sandra Day O'Connor firmly rejected Alito's troubling logic:
"A State may not give to a man the kind of dominion over his wife that parents exercise over their children." (Planned Parenthood of Southeastern Pennsylvania v. Casey, 505 U.S. 833 (1992) at 898.)

And that is one of his less radical views

In a 1985 memo Alito had advised the Reagan Administration that it should attempt to undermine Roe v. Wade.  Alito urged the administration to file a friend-of-the-court brief in Thornburgh v. American College of Obstetricians and Gynecologists, and argued that this brief could promote "the goals of bringing about the eventual overturning of Roe v. Wade, and in the meantime, of mitigating its effects."

Alito wanted the administration to "make clear" that it "disagree[d] with Roe v. Wade," but argued that the most effective long-term strategy of persuading the Supreme Court to overturn this groundbreaking precedent was to chip away at it slowly through extremely restrictive state laws. OverturningRoe v Wade would most certainly result in a return to the days of dangerous "illegal" abortions.

Is this the kind of nomination that sounds like a moderate?  This candidate is not representative of my views, nor of mainstream America.

Alito clearly has no problem with forcing his radical ideals on women

I strongly urge you to vote against this horrible nomination because no woman should be forced by anyone to have to resort to using a coat hanger to perform a back alley abortion.  When you consider that Alito's warped views would be replacing the moderate voice of Sandra Day O'Connor there should be no doubt that Alito's nomination must be stopped.

Great work, Tampopo. I looked through the yahoo stuff as you & others worked on this, but said nothing.  

One thought about gender discrimination - anything from his reported membership in that anti-female student org. of Princeton alums?  Wish I could do something to help right now, but am in end of term insanity for most of the rest of the month.

I've got an idea for this one - perhaps a list of women who have graduated from Princeton who have made a difference in the world.  Or even "non-famous" women.  Point out that if had been up to Alito and his CAP buddies, these women might not have their degrees.

Would you be willing (able) to do a bit of checking on this? Perhaps minorities too?

Alito graduated from Princeton in 1972.

I was thinking of the current stress in schools dealing with NCLB - just getting some kids through school to a H.S. diploma is so challenging. The idea Alito considered limiting anyone's acceptance to Princeton is so offensive!

Could you write an e-mail/fax diary on this? What I mean is your diary would be the one we all could use on this topic.

So if you write it and post it on day 7, Sun., Dec.18th, titled: For Justice - Day 8, we can all use it on Monday which is day 8.

Does that make sense?
