One-Man Rule

One issue trumps any other, including abortion: This week's confirmation hearings of executive power adherent Samuel Alito may be our last real chance to safeguard the U.S. Constitution from "one-man rule," as Other Lisa describes "the Bush Administration's extra-legal activities" in her review of "The President and the Law," a shocking Weekly Standard article by "Bushevik apologist Harvey Mansfield" which, Glenn Greenwald says, "sets forth with perfect clarity the view of Bush defenders -- as previously expressed by, among others, Dick Cheney – that as a result of the 'war' we are fighting against terrorists, the President really is above the law; he is the law; and the Constitution gives him the right to ignore both Congress and the courts":

Bush opponents must make clear to Americans that this is the theory on which the Bush Administration is based.

(Independently, Americans also ought to know, and the Senate needs to find out, whether and to what extent Sam Alito agrees with these views of Executive power and the rule of law. Maybe Joe Biden could give Alito a homework assignment of reading Mansfield's article and be prepared to discuss it at the hearings). [...]

[T]o recap: The President is "larger" than the law. The "rule of law is not enough to run a Government." We must remember that a monarchy is "effective" and therefore, in times of "war" (like now), we must embrace "one-man rule." In sum, in emergencies like the one we have now and will have for the indefinite future, the "law does not apply."

We really need to pull out all the stops on this one.

Now I have a double-edged action for you. Go to this link and use their internet resources (glut them up with traffic) to voice our Anti-Alito message!

They will have trouble getting as many messages out because of the increased traffic, and if we work hard their resources will be sending MORE ANTI-Alito messages than messages in support.

Yeah... I'm evil!

Thanks Susan for, once again, keeping our eyes on the prize. This is the key issue - all of the others that are so important hinge on whether we can keep our checks and balances in place or we continue to drift towards unfettered Presidential power.

That way lies tyranny and fascism.

And focusing on this is our best hope for success. We have to hope that the Senate sees the "unitary presidency" as a threat to their own power, and rebels. They may have selfish, ego-driven reasons for not wanting to relinquish their power - but the framers knew human nature pretty well. By fighting for their power, for whatever reason, they are also fighting for us to have a voice against the natural dictatorial tendencies of any executive.

Good to see this point starting to come up. I have made the general point repeatedly over the past two years at Kos.  Civil rights -- by which we now must mean freedom from arbitrary arrest, detention, and punishment, trumps everything else.  It was evident from 2003, if not before, that this is an administration that puts ends above means -- indeed, may in some circles consider that the means are the end.  The Scalito hearings ought to be a vehicle for airing these points.  The detention state won't survive the light of day.
